assignment

Project description
This week you read abut the advantages and disadvantages of group living. I would like you to watch a primate cam for any group behavior you learned about this week. Record interactions, displays, communication, grooming, parenting, protecting, etc. that you see. Keep in mind that these animals are forced to live together and do not have the option of moving to another group or dispersing on their own. For example, orangutans are solitary creatures in the wild, but live together and with siamangs at the San Diego Zoo. Do the behaviors you recorded represent an advantage or disadvantage to group living? Do you think you would see this behavior in the species you watched if you were studying wild populations?

To complete this week\’s assignment:

1) Select one of the links below or google, \’ape cam\’, for more links.

2) Watch the primates for at least a half hour.

3) If the primates are in active or uncooperative, try the other cam or try back later. Please note that cams will not be viewable after dark local time.

4) Please record any displays or interactions between individuals or the group at large. Find references that will help you determine if this behavior is typical for groups of this species living in the wild.

5) Write a paragraph about the data you recorded. You should: a) mention the cam and the species you studied. b) Give a general description of what you observed. c) Describe how the interaction you saw was a benefit or disadvantage of group living. d) discuss whether the behavior you saw typical for your species or a product of the zoo environment? e) CITE REFERENCES.

Two primate cams I recommend:

First, find an article about a civil case (not criminal). Pick your own or you can use Trump as we discussed in class with the video. Then, create a paper exactly like our group project. However, I want two additional sections in this. First, start your paper with a summary of the facts. Second, end your paper with a conclusion. The middle should be exactly like your project: causes of action, elements of each cause of action, and then apply the facts to the law. You will represent the PLAINTIFF.

Porsche Responds to Paul Walkers Lawsuit

We represent Porsche. Porsche is the defendant in this lawsuit where the plaintiffs are Meadow Walker, Paul Walker Sr. and Kristine Rodas. The plaintiffs are suing Porsche for Paul Walker and Roger Rodas wrongful death, negligence, and product liability.
Paul Walker died at the age of 40 when his Porsche Carrera crashed and burst into flames in Valencia, Santa Clarita, on November 30th, 2013. The driver who was Roger Rodas lost control of the vehicle, which then crashed into trees and a concrete lamppost, killing both men.

Wrongful Death
For the defendant to be liable for wrongful death, the plaintiff must prove that the fatal accident was caused by the car makers negligence. They must provide evidence that the driver was operating the vehicle as a reasonably prudent person would.

Negligence
To prove negligence the plaintiff must present evidence that the defendant breached the due care duty and that this breach of duty caused or contributed to the harm.

Product Liability
In order to prove product liability the plaintiff must show that the product that caused the injury was somehow defective in manufacture, design, packaging or failure to warn the danger of the vehicle.

In the imposition of Wrongful Death, Porsche has proves by the law enforcement that the real cause of the fatal solo-vehicle collision was driving at an unsafe speed. Investigators found that Paul Walker and Roger Rodas were driving at rates between 80 and 93 MPH. The speed limit for the street where the accident took place was 45 MPH. They were doing well over the speed limit posted for that street. There was also evidence that both Paul and driver Roger Rodas wore seatbelts and that the airbags deployed for both the driver and the passenger.

There is no evidence that shows any kind of negligence from the car manufacturer. Porsche alleges that Paul Walker \”knowingly and voluntarily assumed all risk, perils and danger in respect to the use of the subject 2005 Carrera GT.\” The company goes on to state that the risk and dangers were open and obvious and known to him and that he chose to conduct himself in a manner so as to expose himself to such perils, dangers and risks, thus assuming all the risks involved in using the vehicle.

To satisfy the elements of Product Liability Porsche can prove that there was an abnormal misuse of the vehicle – a manufacturer is relieved of product liability if the plaintiff has been injured by an abnormal misuse of the product. Supervening event was also involved which means the manufacturer is not liable if the product is materially altered or modified after it leaves the sellers possession and alteration of modification causes an injury. Paul Walkers car (porsche Carrera GT) in the accident was abused and altered in a matter that was not reasonably foreseeable to the company. The tires on the car had been altered which could have had an impact on the accident. Ultimately, that abuse and alteration proximately caused or contributed to the incident.

Thus, Porsche cannot be held liable for wrongful death, negligence or product liability. Paul Walker \”was a knowledgeable and sophisticated user of the car.\” When driving a car like the Carrera GT extreme caution must be taken because of the fact that the car can travel at great speeds. The evidence shows the excessive speed, irresponsible driving and inappropriate actions like altering the car before driving sadly led to the fatal crash and death of Paul Walker.

managerial accounting

Project description
Throughout the course, we have discussed successful managerial accounting and reporting decisions as the culmination of a managers thoughtful consideration of trade-offs. The answer to many of our questions has been, it depends as the facts and circumstances of the manager, organization, strategy and goals are often what shapes both the decision made and its chance of success. This has been the case throughout all of the primary domains of the course: costing, decision-making and analysis (such as CVP and differential analysis), and performance measurement and management.
With that said, there have been some overarching themes that we have discussed that have applied both within and across the primary domains of the course. For example, we have talked at length about the implications of expressing fixed costs as a unitary measure in costing decisions, differential analysis, and performance measurement.
Please identify what you would consider to the be three most important overarching themes (and corresponding takeaways) of the course, describe and define each theme, discuss how it applies across all three domains, and explain why you these themes and takeaways would make your top three list. When I say important, I mean in regards to your own career and life goals. Keep in mind that I do not know what these goals are unless you tell me, so youll want to work this into your submission. Also, please underline each theme the first time it is referenced so it is abundantly clear what you have selected to discuss. Finally, please do not choose more than three themes.
Your answer will be evaluated based on the quality of your response, which includes your demonstrated knowledge of the breadth of the course material, the depth of your chosen themes, and your ability to tie these to your own goals. In this assignment, I am evaluating your ability to demonstrate your understanding of the big picture learning points of the course as they relate to your goals as a person and future leader. I encourage you to be creative, to the extent that it does not cloud my ability to assess your understanding, and to tie these themes back to what is truly important to you.
